Journalism and free speech trials: Week of June 7
This week several journalism and freedom of expression trials will resume at courts. Below is a list of this week’s hearings:

8 June Tuesday

  • Third hearing of the trial where Mesopotamia Agency (MA) reporter Melike Aydın  faces “membership in a terrorist organization” charges based on phone conversations with her news sources and a book titled “The Color Purple of Kurdish Politics” found in her home during a police raid will be held at İzmir 2nd High Criminal Court this week.
  • Fifth hearing of the trial where Mesopotamia Agency (MA) reporter Ruken Demir faces “membership in a terrorist organization” charges based on phone conversations with her news sources will be held at İzmir 19th High Criminal Court this week. Ruken Demir was arrested on November 26, 2019 and was released pending trial during the first hearing.
  • Trial where Mesopotamia News Agency (MA) reporters Sadiye Eser and Sadık Topaloğlu face “membership in a terrorist organization” charges will resume at İstanbul 22nd High Criminal Court this week. Eser and Topaloğlu were detained on Nov 29, 2019 shortly after they left the news agency’s building and were arrested on Dec 3, 2019. Journalists were released during the first hearing held on Mar 26, 2020.
  • Trial where journalist Rüstem Batum faces “insulting the President” charges pursuant to Turkish Penal Code’s Article 299 will resume at İstanbul 41st Criminal Court of First Instance this week Batum, whom MLSA represents in court, faces this charge for statements he made during a TV appearance on journalist Ayşegül Doğan’s programme on İMC TV in September 2015. 
  • Re-trial where journalist and novelist Ahmet Altan is accused of insulting the Supreme Court of Appeals Prosecutor in a column published in Taraf daily on Mar 16, 2008 will resume at Anadolu 2nd Criminal Court of First Instance this week.
  • Trial where journalists Ali Açar, Canan Coşkun and Cansever Uğur face “disclosing or publishing the identities of state officials on anti-terror duty and/or identifying them as targets” charges will resume at İstanbul 34th High Criminal Court this week. Journalists Açar and Coşkun are on trial for a news report published in Cumhuriyet daily on 11 March 2016 titled “Cop who allegedly shot Berkin Elvan did not remember his place of duty” and Uğur for another new report published on BirGün’s website titled “Reason of the confidentiality order in Berkin investigation: Not to defame the murderer.” 

9 June Wednesday

  • Second hearing of the trial where lawyer and human rights defender Nurcan Kaya faces “consecutively making terror propaganda” charges for her Twitter posts will be held at Diyarbakır 9th High Criminal Court this week.
  • Third hearing of the trial where journalist Nurcan Yalçın faces “membership in a terrorist organization” and “making terror propaganda” charges will be held at Diyarbakır 9th High Criminal Court this week. Yalçın was indicted as part of the investigation launched against Rosa Women’s Association, a Diyarbakır-based civil society organization founded in December 2018. Evidence presented against Yalçın include a secret witness statement claiming that she is a “senior authority” of the Rosa association and documents confiscated while the association’s headquarters were raided.

10 June Thursday

  • Trial where journalist Hayko Bağdat faces “terror propaganda” charges based on nine social media posts from 2017 and 2018 will resume at İstanbul 28th High Criminal Court this week. Social media posts that are used as evidence against Bağdat, whom MLSA represents in court, include retweeting a photo of Osman Kavala and retweeting an interview with PKK leader Cemil Bayık.
  • First hearing of the trial where Van-based freelance journalist Ruşen Takva faces “membership in a terrorist organization” charges for covering a demonstration that was supposed to take place in Van will be held at Van 2nd High Criminal Court this week. Takva is accused of attempting to cover the press statement and the subsequent march organized under the title “Liberation and National Unity of the Kurdish People” with the participation of Democratic Social Congress (DTK) Co-Chair and HDP Ağrı MP Berdan Öztürk. The indictment claims that Takva was “one of those who organized and ran the march” and “continued with the demonstration and marching despite warnings suggesting that the event was banned” and requests up to 18 years in prison for the journalist.

11 June Friday

  • Fourteenth hearing of the trial where journalist Rüstem Batum faces “publicly denigrating the state’s military and law enforcement personnel” charges pursuant to Turkish Penal Code’s notorious Article 301 will resume at İstanbul 43rd Criminal Court of First Instance. Batum, whom MLSA represents in court, faces this charge for statements he made during a TV appearance on journalist Ayşegül Doğan’s programme on İMC TV in September 2015. 
  • Fifth hearing of the trial where Progressive Journalists’ Association’s (ÇGD) Mediterranean Region head and Körfez newspaper’s Managing Editor Engin Korkmaz faces “insulting the President” charges will be held at Antalya 19th Criminal Court of First Instance this week.
